1. Acceptance of Terms

By accessing and using Kurboed (the "Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms apply to all users of the Service, including parents, legal guardians, students, educators, and administrators.

These Terms incorporate by reference our Privacy Policy and Cookie & Storage Policy.

Kurboed is an AI-powered educational platform designed for students in classes 1 through 8 (approximately ages 6–18). Our Service provides:

• Interactive learning assessments across multiple subjects and topics
• AI-generated educational questions tailored to grade level and difficulty
• Progress tracking and performance analytics for parents
• Parent-controlled student profiles and account management
• Worksheets, topic-level assessments, and downloadable reports
• Exportable "Achievement Cards" for parent-initiated progress sharing
• A safe, ad-free digital learning environment

The Service is intended for educational purposes only and is not a substitute for formal schooling, tutoring, or professional academic guidance.

3.1 Eligibility

• You must be at least 18 years old to create an account
• Accounts must be created by a parent or legal guardian
• Children (students in classes 1–12) may not create their own accounts
• An invitation code is required to register (available from your school or administrator)

3.2 Account Responsibilities

By creating an account, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the confidentiality of your password and account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately at teams.kurboed@gmail.com of any unauthorized access to your account
• Supervise your child's use of the Service

3.3 Student Profiles

Parents may create and manage student profiles under their account. Each student profile requires only a name (or nickname) and grade level. Parents have full control over creating, editing, and deleting student profiles.

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Upload, transmit, or share harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to our systems, other user accounts, or restricted areas
• Interfere with, disrupt, or impose an unreasonable load on the Service
• Use the Service for any commercial purpose without prior written permission
• Use automated scripts, bots, or scrapers to access the Service (except as explicitly permitted)
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity
• Share your account credentials with unauthorized persons

We reserve the right to suspend or terminate accounts that violate these terms.

Our platform uses artificial intelligence to generate educational questions and content. By using the Service, you acknowledge and agree that:

• Some questions, explanations, and hints are generated by AI models
• AI-generated content is intended for educational purposes and may occasionally contain errors
• AI-generated content does not constitute professional academic advice, tutoring, or certification
• Administrators review AI-generated questions before they are made available to students
• AI models do not receive or store children's personal information — they generate content based on academic parameters only

7. Privacy & Data Protection

Your privacy is critically important to us. Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key commitments:

• We comply with applicable privacy laws including COPPA, CCPA/CPRA, DPDP Act 2023, and IT Act 2000
• We do not sell, rent, or trade personal information to third parties
• We do not display advertisements or allow behavioral tracking
• We collect only the minimum data necessary for educational services
• Parents have full control over their family's data

8. Intellectual Property Rights

The Service and its original content (including but not limited to text, graphics, logos, icons, images, software, and AI-generated educational material) are the property of Kurboed and are protected by applicable copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial, educational purposes.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Service without our prior written consent, except for downloading student progress reports and worksheets for personal use.

9. Subscription & Payment Terms

Certain features of the Service may require a paid subscription. If applicable:

• You agree to pay all fees associated with your subscription plan
• You must provide accurate and complete billing information
• Subscriptions may auto-renew unless cancelled before the renewal date
• We will provide at least 30 days' notice of any price changes
• Refund requests are handled on a case-by-case basis — contact teams.kurboed@gmail.com

Currently, the platform operates on an invitation-only basis. Payment terms will be communicated separately when paid plans are introduced.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• Kurboed shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, goodwill, or other intangible losses
• Our total aggregate liability for any claims arising from use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or the equivalent of $100, whichever is greater
• We are not liable for the accuracy of AI-generated educational content or any educational outcomes

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, timely, or error-free
• Results obtained from the Service will be accurate, complete, or reliable
• Any defects in the Service will be corrected within a specific timeframe
• The Service will meet specific educational outcomes or curriculum standards

Kurboed is a supplementary educational tool. It does not replace formal education, qualified tutoring, or professional academic assessment.

12. Termination

We may suspend or terminate your account and access to the Service:

• Immediately, for violations of these Terms or our Acceptable Use Policy
• With 30 days' notice, for discontinuation of the Service or significant changes

You may terminate your account at any time by contacting us at teams.kurboed@gmail.com.

Upon termination, your right to use the Service ceases immediately. We will delete or anonymize your personal data within 30 days, except where retention is required by law. Sections of these Terms that by their nature should survive termination (including Sections 8, 10, 11, and 13) shall survive.

13.1 Applicable Law

These Terms shall be governed by and construed in accordance with the applicable laws of the jurisdiction in which Kurboed operates, without regard to conflict of law provisions. Any disputes shall be resolved in the competent courts of that jurisdiction.

13.2 Additional Regulatory Compliance

Depending on your location, these Terms may also be subject to additional applicable laws such as the COPPA, CCPA/CPRA, DPDP Act 2023, Information Technology Act 2000, or consumer protection legislation in your jurisdiction. Disputes may also be resolved through the grievance mechanism specified in our Privacy Policy or through the appropriate consumer forum or court in your jurisdiction.

13.3 Informal Resolution

Before filing any formal legal action, you agree to attempt to resolve the dispute informally by contacting us at teams.kurboed@gmail.com. We will attempt to resolve the dispute within 30 days.

14. Indemnification

You agree to indemnify, defend, and hold harmless Kurboed, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit through the Service.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes:

• We will update the "Last updated" and "Effective" dates at the top
• We will send an email notification to registered users
• We will display a notice within the Service
• For changes affecting children's data, we will obtain renewed parental consent where required by COPPA

Your continued use of the Service after changes become effective constitutes acceptance of the new Terms. If you do not agree with the updated Terms, you must stop using the Service.
